Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and Email Cleaner ("we", "us") governing your use of the website and service at https://emailcleaner.xyz (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

You must be at least 16 years old. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it.

2. What the Service does

The Service connects to email mailboxes you authorise and, on your instruction, finds and deletes messages matching criteria you define — by folder, by keyword, by sender, by date, by size or by a combination. It can move messages to your provider's Trash folder (reversible) or delete them permanently (not reversible), and can run saved rules on a schedule.

The Service does not send email, does not modify message content, and does not access attachments.

3. Deletion is your decision

This section matters more than any other in these Terms.

• You define the rules. The Service executes what you specify. A rule that matches more messages than you expected will delete more messages than you expected.
• We show you a preview. Every job counts matches and presents a breakdown and sample before any deletion. You are responsible for reading it before confirming.
• Trash mode is reversible; permanent mode is not. Permanent deletion bypasses Trash and cannot be undone by us, by you, or by your email provider.
• Undo is best-effort and time-limited. It depends on your provider retaining the messages in Trash and on the undo window for your plan. It is not a backup.
• Keep your own backups. The Service is not a backup solution and must not be relied on as one. If mail matters to you, back it up independently before running a cleaning job.

To the maximum extent permitted by law, we are not liable for the deletion of any message, including deletion resulting from a rule you wrote, a preview you confirmed, a scheduled rule you enabled, or a provider failing to retain messages in Trash.

4. Your account

• Provide accurate registration information and keep it current.
• You are responsible for all activity under your account.
• Keep your password confidential. We strongly recommend enabling two-factor authentication.
• Store your recovery codes safely. If you lose both your authenticator and your recovery codes, we may be unable to restore access.
• Tell us promptly at security@emailcleaner.xyz if you suspect unauthorised access.
• One person or organisation per account. Do not share credentials.

5. Mailbox authorisation

You may only connect a mailbox that you own or are expressly authorised to administer. By connecting a mailbox you represent that you have that authority and that your use complies with any applicable organisational policy, employment agreement or law.

You are responsible for the consequences of connecting a shared or organisational mailbox, including deletion of mail belonging to or relied upon by others. Connecting a mailbox without authorisation is a material breach of these Terms and may be unlawful.

6. Third-party providers

The Service operates through APIs and protocols supplied by Google, Microsoft, Yahoo, Apple and other email providers. Your use of those mailboxes remains governed by your agreement with that provider.

• We are not affiliated with, endorsed by or sponsored by any email provider.
• Providers may change, rate-limit, suspend or withdraw API access at any time, which may degrade or disable parts of the Service without notice.
• Provider-imposed limits — for example Microsoft's cap of 1,000 results per keyword search — may affect completeness. The Service discloses such limits in the preview where they apply.
• You may revoke our access from your provider at any time; doing so stops the Service working for that mailbox.

7. Acceptable use

You must not:

• connect a mailbox you are not authorised to control, or use the Service to destroy evidence, or to delete mail that you are under a legal, regulatory or contractual obligation to preserve;
• use the Service to violate any law, or the terms of any email provider;
• attempt to circumvent plan limits, rate limits or safety confirmations;
• probe, scan or test the security of the Service except under a vulnerability report made in good faith to security@emailcleaner.xyz;
• reverse engineer, scrape, resell or white-label the Service without written permission;
• upload or process content that is unlawful or infringes another party's rights;
• interfere with the Service's operation or another user's use of it.

We may suspend or terminate accounts that breach this section, without refund.

8. Plans, billing and changes

• Plan features and limits are described on the pricing page and enforced by the Service.
• Paid plans are billed in advance for the period selected. Prices are in US dollars and exclude any taxes you may owe.
• Subscriptions renew automatically until cancelled. Cancel at any time; access continues to the end of the paid period.
• Except where required by law, payments are non-refundable. We may make discretionary refunds.
• Downgrading may make existing mailboxes or rules exceed your new limits; the Service will stop allowing new ones until you are back within them.
• We may change prices with at least 30 days' notice to existing subscribers, effective from the next renewal.
• Where a plan is offered free of charge, we may modify or discontinue it with reasonable notice.

9. Availability and support

We aim for high availability but do not commit to an uptime level unless separately agreed in writing. We may perform maintenance, and may modify or discontinue features. We will give reasonable notice of material adverse changes where practicable.

Support is provided by email on a reasonable-efforts basis, with priority according to plan.

10. Intellectual property

The Service, its software, design and content are owned by us and protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service under these Terms. You retain all rights in your own data and mailbox content; you grant us only the limited licence needed to operate the Service for you.

All third-party names and marks are the property of their respective owners and are used only to describe compatibility.

11. Privacy

Our handling of data is described in the Privacy Policy, which forms part of these Terms. In particular, our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

12. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, non-payment, or where required by law — with notice where practicable, and immediately where the risk warrants it.

On termination, your right to use the Service ends and stored credentials are destroyed immediately. Remaining data is deleted as described in the Privacy Policy. Sections 3, 10 and 13 to 16 survive termination.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that it will identify every message matching your criteria, or that deleted messages can be recovered.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR LOSS OR CORRUPTION OF DATA OR EMAIL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

15. Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of any law or third-party right, or your connection of a mailbox you were not authorised to control.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of India shall have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer, you retain the benefit of any mandatory protections of your country of residence.

Before filing a claim, please contact us at support@emailcleaner.xyz so we can try to resolve it informally.

17. Changes to these Terms

We may update these Terms. Material changes will be notified to registered users by email at least 14 days before they take effect, and the "last updated" date above will change. Continued use after the effective date constitutes acceptance. If you do not accept a change, stop using the Service and delete your account.

18. General and contact

These Terms, with the Privacy Policy, are the entire agreement between us. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition.
